These Terms and Conditions (“Terms”) govern your use of the website operated by
Augustus Mungoi Couture Ltd (“we”, “us”, “our”) and the supply of products by us to you. By placing an order with us, you confirm that you have read, understood and agree to be bound by these Terms.

2. DEFINITIONS
In these Terms the following definitions apply:
- “Consumer” means an individual acting for purposes which are wholly or mainly outside his or her trade, business, craft or profession.
- “Goods” means the clothing and fashion products we supply to you.
- “Contract” means the contract between you and us for the supply of Goods in accordance with these Terms.
- “Order Acknowledgement” means the email we send acknowledging receipt of your order.
- “Dispatch Confirmation” means the email we send notifying you that the Goods have been dispatched.
3. REGISTRATION AND WEBSITE USE
3.1 You must be at least 18 years old and have full legal capacity to enter into binding
contracts to purchase Products.
3.2 You agree to use our website in compliance with all applicable laws and not to use it
for any fraudulent or unlawful purpose.
3.3 We reserve the right to suspend or terminate access to the website or refuse to accept an order if we believe you are in breach of these Terms or our policies.
4. PRE-CONTRACT INFORMATION
4.1 Prior to you placing an order we will provide the following information:
(a) main characteristics of the Goods;
(b) price inclusive of any taxes;
(c) delivery costs;
(d) payment and delivery methods;
(e) your cancellation rights, where applicable.
4.2 By placing an order, you acknowledge that you have received, read and accepted that pre-contract information.
5. ORDER PROCESS
5.1 After placing an order you will receive an Order Acknowledgement. This does not constitute acceptance of your order.
5.2 A Contract is formed when we send the Dispatch Confirmation to you, at which point
we will have accepted your order.
5.3 We reserve the right to refuse or cancel any order for reasons including but not limited to: suspected fraud, payment issues, or unavailability of stock.
5.4 All prices are presented in British Pounds (GBP) and include UK VAT (where applicable). Delivery charges are shown separately at checkout.
5.5 Payment must be made via the methods stated at checkout. Title to the Goods passes to you only upon our receipt of full payment. Risk in the Goods passes to you on delivery.
6. PRODUCT AVAILABILITY, DESCRIPTION AND PRICE
6.1 We endeavour to ensure that product descriptions, pictures, sizes and colours are accurate. However, some variation may occur due to screen settings, fabric dye batches or manufacturing variances.
6.2 All Goods are subject to availability. We may withdraw or substitute Goods without
notice.
6.3 Prices may change from time to time. If a price is clearly incorrect due to a
typographical error, we will not be obliged to fulfil the order at the incorrect price.
7. DELIVERY
7.1 We aim to dispatch orders promptly, but actual delivery times will depend on destination and shipping method chosen.
7.2 We will provide tracking information where applicable.
7.3 We shall not be liable for any delays in delivery caused by events outside our
reasonable control (see Section 14).
7.4 International customers are responsible for any import duties, taxes or customs charges incurred.
8. RIGHT TO CANCEL (CONSUMERS)
8.1 If you are a Consumer, you may cancel your Contract within 14 calendar days from the day after you (or a third party you nominate) receives the Goods.
8.2 To exercise this right you must notify us in writing (e-mail acceptable) at [customercare@augustusmungoi.com]
stating your order number and intention to cancel.
8.3 After cancelling you must return the Goods within 14 days of notifying us, at your cost unless the Goods are faulty or incorrect. The Goods must be returned unused, unwashed,
with tags attached and in original packaging.
8.4 We will refund the price of the Goods and applicable delivery cost within 14 days of receiving the returned Goods or proof of return.
8.5 This cancellation right does not apply to:
(a) customised, personalised or made-to-measure Goods;
(b) Goods sealed for hygienic reasons which have been unsealed after delivery;
(c) Goods which due to their nature cannot be returned or are liable to deteriorate rapidly.
9. RETURNS, EXCHANGES AND REFUNDS
9.1 If you wish to return Goods outside the statutory cancellation period, we may, at our discretion, offer an exchange or store credit.
9.2 Conditions for return: Goods must be unused, unwashed, in original packaging with all
tags attached.
9.3 Refunds are made using the original payment method.
9.4 Your statutory rights regarding faulty or mis-described Goods are unaffected (see Section 10).
10. FAULTY OR DEFECTIVE GOODS – STATUTORY RIGHTS
10.1 Under the Consumer Rights Act 2015 you have rights when Goods are faulty, not as
described or unfit for purpose.
10.2 If Goods are faulty you must notify us promptly and we will, at our option, arrange repair, replacement or refund.
10.3 Nothing in these Terms limits or excludes your statutory rights.
11. INTELLECTUAL PROPERTY
All intellectual property rights (including but not limited to copyrights, trademarks and design rights) in our website, its content and the Goods remain our property or the property of our licensors. No licence is granted to you to use any such intellectual property
except as necessary for you to receive and use the Goods.
12. LIMITATION OF LIABILITY
12.1 We shall not be liable for any indirect, special or consequential loss arising out of or in connection with your purchase of Goods, provided this limitation is permitted by law.
12.2 Nothing in these Terms limits or excludes liability for:
(a) death or personal injury
caused by our negligence;
(b) fraud or fraudulent misrepresentation;
(c) any other liability
which cannot be excluded or limited by law.
12.3 Our aggregate liability under or in connection with the Contract shall not exceed the price paid by you for the Goods in question.
13. DATA PROTECTION & COOKIES
13.1 We process personal data in accordance with the UK General Data Protection
Regulation (“UK GDPR”) and our Privacy Policy, which is incorporated by reference into these Terms.
13.2 Our website may use cookies or similar technologies. By using our website you consent to such use in accordance with our Cookie Policy.
14. FORCE MAJEURE
We shall not be liable for any delay or failure in performance of our obligations under
these Terms to the extent that such delay or failure is caused by an event beyond our reasonable control, including but not limited to act of God, war, strike, fire, flood, pandemic, governmental regulations, failure of suppliers or subcontractors, or any other
event of force majeure.
15. AMENDMENTS AND ENTIRE AGREEMENT
15.1 We may amend these Terms at any time. Revised Terms will be posted on our website and take effect immediately upon posting. By continuing to use our website or placing
further orders you accept the revised Terms.
15.2 These Terms and our Privacy Policy constitute the entire agreement between you and us in respect of the supply of Goods and supersede any prior agreement, representation
or correspondence.
15.3 If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
16. GOVERNING LAW AND JURISDICTION
These Terms, and any Contract between you and us, are governed by the laws of England and Wales. You and we both agree that the courts of England and Wales shall have non- exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms. Consumers in Scotland or Northern Ireland may also bring proceedings in their local courts.
